Terms of Service
Please read these Terms of Service ("Terms") carefully before using Resonance: HRV Biofeedback ("the App"). By downloading or using the App, you agree to these Terms.
1. Who We Are
Resonance: HRV Biofeedback is developed by Groma Apps ("we", "us"). Contact: murray@gromalabs.com
2. Not a Medical Device
- Resonance: HRV Biofeedback does not diagnose, treat, cure, or prevent any disease or medical condition.
- Heart-rate and HRV measurements are for personal wellness use only and are not intended for medical diagnosis.
- If you have a heart condition, arrhythmia, pacemaker, or other cardiovascular condition, consult your physician before using any HRV-based app.
- Do not use the App as a substitute for professional medical advice, diagnosis, or treatment.
3. Eligibility
You must be at least 13 years old to use the App. By using the App, you represent that you meet this age requirement.
4. License
We grant you a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial purposes, subject to these Terms.
You may not:
- Copy, modify, or distribute the App
- Reverse engineer or decompile the App
- Use the App for commercial purposes without our written permission
5. Pricing & Donations
Resonance: HRV Biofeedback is free. All features are available to all users without any purchase. An optional in-app donation is available for users who wish to support development. Donations are processed through Google Play and are governed by Google Play's terms. Donations are voluntary and non-refundable; they do not unlock any additional features.
6. Data & Privacy
Your use of the App is also governed by our Privacy Policy. By using the App, you consent to the data practices described there.
7. Disclaimer of Warranties
THE APP IS PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED. WE MAKE NO WARRANTIES THAT THE APP WILL BE ERROR-FREE OR UNINTERRUPTED, THAT HRV MEASUREMENTS WILL BE ACCURATE FOR ANY SPECIFIC PURPOSE, OR THAT THE APP WILL MEET YOUR SPECIFIC HEALTH OR FITNESS GOALS. USE OF THE APP IS AT YOUR OWN RISK.
8. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE APP, INCLUDING BUT NOT LIMITED TO PERSONAL INJURY, HEALTH-RELATED CLAIMS, LOSS OF DATA, OR LOSS OF REVENUE. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM THESE TERMS OR THE APP SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE APP IN THE 12 MONTHS PRECEDING THE CLAIM.
9. Third-Party Services
The App uses Firebase services (Google LLC) for analytics, crash reporting, and feedback storage. Your use of these services is subject to Google's Terms of Service.
10. Changes to These Terms
We may update these Terms at any time. Continued use of the App after changes constitutes acceptance of the new Terms. Material changes will be communicated via an in-app notice.
11. Governing Law
These Terms are governed by the laws of the State of Colorado, United States, without regard to conflict-of-law principles.
